The Interim Measures for Hong Kong, Macao and Taiwan Residents to Join the Social Insurance Scheme in Mainland China was Released to Solicit Public Opinion

The Ministry of Human Resources and Social Security (“MOHRSS”) has drawn up and released the Interim Measures for Hong Kong, Macao and Taiwan Residents to Join the Social Insurance Scheme in Mainland China (Exposure Draft) to solicit opinions from the public before November 25, 2018. The Exposure Draft stipulates that the employer shall contribute for the basic pension insurance, basic medical insurance, work-related injury insurance, unemployment insurance and maternity insurance for the employees who are Hong Kong, Macao or Taiwan residents according to the laws and regulations. The standards for social insurance contribution and the conditions for enjoying social insurance benefits by the employees who are Hong Kong, Macao or Taiwan residents shall be the same as those for Mainland China residents. However, if employees who are Hong Kong, Macao or Taiwan residents have joined the local social insurance in Hong Kong, Macao or Taiwan and retain such local social relationship, the said employees may choose not to join the basic pension insurance and unemployment insurance in Mainland China if due certificates could be issued by the social insurance authorities in Hong Kong, Macao or Taiwan.
