Colombia: The Labour Procedural Code Bill Currently in the Second Debate in Congress

This is an update to our article Colombia: New Labour Procedural Code Bill to be Submitted for First Debate in Congress, published in April of this year.

The Labour Procedural Code, in force in Colombia for over 70 years, is currently undergoing an update. In August of last year, the Labour Chamber of the Supreme Court presented its proposed reform to the Labour Procedural Code and Social Security (CPTSS) to Congress. On July 19th, 2024, this new Code was approved in its second debate, aiming to modernize and streamline procedures, unify jurisprudence, and align judicial administration with the current times.

Some of the relevant points discussed included the simplification of procedures and judicial processes in labour matters. Issues such as job stability are reinforced by several types of protections, such as union law, circumstantial, maternity, disability, pre-pension, and workplace harassment, which will be processed through special procedures.

These changes aim to leverage technological advancements and virtual platforms by implementing electronic systems and digital tools. This initiative seeks to expedite processes and securely streamline access to justice.
