China: The Measures for Disclosure of Information on Labor Security Violations in Shenzhen Has Come into Effect as of December 1, 2018
Shenzhen Municipal Human Resources and Social Security Bureau formulated the Measures for Disclosure of Information on Violations of Labor Security in Shenzhen (the “Measures”). The Measures has come into effect as of December 1, 2018. The Measures stipulate that, employers that commit the following major violations of labor security will be disclosed to the public, listed on the credit information sharing platform, and punished jointly by relevant departments within the scope of these departments’ respective duties: (1) suspected criminal offence as in refusal to pay remuneration to employees; (2) illegal employment of child labor; (3) serious violation of laws and regulations in respect of employee working hours, rest and leave; (4) serious violation of laws and regulations in respect of special labor protection for female employees and underage employees; (5) failure to pay social insurance premiums in accordance with the law, of which the circumstance is materially serious; (6) cause of a mass incident that involves more than 100 people by any violation of labor security with serious impact to the society at the same time. The period for the above-mentioned information on major violations of labor security to remain public shall be three years.
