Poland: Editorial modifications in the provisions on bullying and unequal treatment of employees may change a lot

The editorial changes in the provisions on bullying and unequal treatment of employees will have a significant impact on the meaning of those rules. Removal of the phrase ‘and particularly regardless of’ from art. 113 (prohibition of discrimination in employment) and art. 183a (the principle of non-discrimination in employment) will result in the adoption of an open catalogue of grounds of discrimination in the Polish Labour Code.

A significant modification will also be made to the provisions on bullying. Currently, the right to claim compensation for bullying is applied only to employees who terminated their contract of employment due to bullying. The novelisation provides for the extension of the circle of eligible persons. Any employee, not just the one who terminated the employment relationship for that reason, will be able to raise the claim.
