Morais Leitão’s Joana Almeida contributes to Chambers Global Practice Guide to Employment 2019

Joana Almeida, Managing Associate and member of Morais Leitão’s employment and pensions team, is the contributing author of the Portuguese chapter on employment law in the latest addition to the acclaimed series, Chambers Global Practice Guide to Employment 2019, Second Edition.

The Portugal Employment guide provides expert commentary on the practical legal issues affecting businesses across the globe, focusing on the framework governing the employment relationship, including wages, working conditions and benefits, as well as the protocols, procedures and limitations associated with the hiring of foreign workers, whether they are EU or EEA citizens, or third party nationals. The Portugal chapter also sheds light on trending issues impacting the workplace, particularly in the field of data protection, where Portuguese law dictates that a combination of the Labour Code regime, the EU General Data Protection Regulation (GDPR) and the national legislation supplementing it, must work in conjunction with one another, and demands employers’ strict adherence to the heightened privacy and security responsibilities applicable to EU employees. The guide also covers CBAs and the role of works councils and trade unions and discusses, at length, matters pertaining to individual and collective redundancies and related litigation, including wrongful dismissal claims and class-actions, plus ADR procedures and remedies.

Brief note about the Author

Joana provides day-to-day consultancy in all areas of labour and social security law, in relation to both individual and collective employment relationships. Acting on behalf of domestic and foreign clients, she has participated in several corporate restructuring processes, provided legal advice on the acquisition and sale of companies and business areas and conducted proceedings for the termination of employment contracts. Joana has also been involved in the conception and implementation of fringe benefit plans of varying sorts. She acts as legal counsel for several clients on labour litigation and social security matters. In the academic circuit, she was a teacher in ISLA’s Postgraduate Studies in Labour law. Author of several articles on labour issues published in specialised magazines, she is also the co-author of the book Código do Trabalho – Três Anos de Jurisprudência Comentada (2007).
