Luxembourg: Important Change for Employees on Sickness Leave
The grand-ducal regulation dated 8 April 2020, which entered into force on the same day, foresees the suspension of the protection period of 26 weeks against termination, which is laid down by article L.121-6 (3) of the Labour Code.
This suspension will apply during the entire sanitary crisis and blocks the employer from terminating with notice the employee on sick leave, except for serious misconduct.
The fraction of the 26 weeks that remains at the beginning of the crisis (18th March 2020) resumes running the day after the end of the crisis (a priori 19th June 2020).
