Poland: New Regulations on Remote Work

Pursuant to the 4.0 Anti-Crisis Act, remote work may only be ordered by the employer if the employee has proper technical means and premises to perform such work, and its type allows for it. In particular, remote work may be accomplished with the use of means of remote communications or may consist of the production of manufacturing parts or material services.

The Act imposes on employers, an obligation to provide employees with the means of work and materials needed to perform work remotely, as well as logistical support. These new regulations also apply to the employees, who may use methods of performing such work, which were not otherwise provided by the employer, but only when such methods ensure the security and protection of confidential information and other legally protected secrets, including business secrets or personal data. Moreover, employees performing remote work are obliged to keep records of activities performed, if so instructed by the employer.
