Dominican Republic: Compensation for Extraordinary Services
The employer must demonstrate overtime payment if the employee proves he has performed an extraordinary service outside of his working day.
Our Supreme Court of Justice reiterates, on August 31, 2022, that once the worker proves that he has provided extraordinary services, the employer must provide the control records of the day to demonstrate that he paid his workers for overtime. Suppose the employer does not present these records. Then, according to article 16 of the Labor Code, the judge will accept the worker’s claims, provided that the number of hours worked over the ordinary working day can be identified.
