Netherlands: House of Representatives Adopts Bill on the Authorisation to Assign Workers

The Dutch House of Representatives recently passed a bill on the permission to assign workers. The bill was submitted to the House of Representatives at the end of 2023 following an investigation into abuses in the temporary employment sector. Read below to find out what changes the proposed law will bring.

The bill on the authorisation of labour (In dutch: Wet toelating terbeschikkingstelling van arbeidskrachten ,WTTA) introduces a public authorisation scheme for companies that provide labour. The aim is to combat malpractice and improve the position of workers, particularly migrant workers.

The heart of the bill is that suppliers of workers will be subject to mandatory authorisation. They will only be allowed to supply workers if they have been authorised to do so by the Minister of Social Affairs and Employment. Recipients may only hire workers from licensed suppliers. In addition, the possibility will be created to impose a ban on temporary agency work in certain sectors and to exclude sectors from the authorisation requirement. The new regulations will apply to all companies that provide workers on a structural basis, regardless of whether this is their main activity.

To be admitted, suppliers of workers must:

  • Submit a Certificate of Good Conduct (VOG) for legal entities.
  • Transfer a financial guarantee of EUR 100,000 (EUR 50,000 for start-ups) to the Ministry of Social Affairs and Employment.
  • Demonstrate that they comply with relevant employment laws, social security laws and tax regulations

The House of Representatives passed the bill on 15 April 2025. The bill will now be reviewed by the Senate, which may only approve or reject it without the possibility of substantive amendments. If approved, the law is expected to take effect on 1 January 2027.
