Indonesia: New Measures for the Implementation of a Work-Related Accident Security Programme

Work-related accident security programmes were previously governed by Indonesian Ministry of Manpower Regulation No 5 of 2021 on the Implementation of Work Accident Insurance, Death Insurance, and Old Age Insurance (“MoM Reg 5/2021”). This regulation stipulates the procedures for registration, reporting and membership under the programmes. The Government further refined the implementing regulation through the issuance of Indonesian Ministry of Manpower Regulation No 1 of 2025 on the amendment of the MoM Reg 5/2021 (“MoM Reg 1/2025”). One of the most significant updates under this new regulation is the expansion of the definition of “work accidents” that are covered by the Work Accident Insurance.

 

Work accidents covered under the Work Accident Insurance include the following:

  1. Accidents that occur because of work and/or at the Workplace as referred to under the provisions of occupational safety and health regulations;
  2. Accidents that occur during travel from home to the Workplace or vice versa, through routes that are commonly or reasonably used;
  3. Accidents that occur while performing official duties or business trips under the instruction of and/or for the benefit of the company and/or Employer, or that are otherwise related to work;
  4. Accidents that occur during working hours or rest periods, either inside or outside the Workplace, while carrying out important and/or urgent matters with the permission or knowledge of the Employer;
  5. Occupational diseases;
  6. Sudden death occurring at the Workplace; or
  7. Acts of physical violence and/or sexual assault that occur at the Workplace and/or in connection with employment.

A notable addition under MoM Reg 1/2025 is the inclusion of incidents of physical violence and sexual assault (Article 7 (2) paragraph g of MoM Reg 1/2025) within the definition of work accidents. Such cases must be substantiated by a police report and supported with a medical forensic examination (visum et repertum). By expressly recognising sexual assault and workplace violence as work accidents, the Government reinforces its commitment to strengthening worker protection against harassment and ensuring that victims are entitled to compensation and safeguards under the Work Accident Insurance framework.
