The Working Environment Act only applies to employees and not independent contractors. The distinction between these two categories is therefore of key importance. The term “employee” is defined in the Working Environment Act, but its precise content has largely been developed through case law.

Introduction

The Working Environment Act applies to any undertaking that engages employees, and it covers most aspects of employment, including working time, health, safety, environment, and job security. In contrast, the Act does not apply where an undertaking engages independent contractors. Accordingly, correctly distinguishing between employees and independent contractors is essential. If an undertaking incorrectly classifies a worker as an independent contractor, it may be held responsible for the legal and practical consequences of that misclassification.
