Peru: New Requirements to Work On-site at Company Premises

Employees are required to be fully vaccinated (one or two doses, depending on the applicable vaccine) in Peru or abroad, in order to be entitled to work on-site at the employer’s premises. This rule has been in force since 10 December 2021. In addition, as of 31 January 2022, the third dose or ‘booster dose’ will be required for workers over 40 years of age, who are clinically allowed to receive such a dose and who work in-person at specific places established by recent regulations.

As from 31 January 2022, the new vaccination rules for employees who work on-site at the employer’s premises are as follows:

a. Every employee who works in-person should be fully vaccinated (one or two doses, depending on the applicable vaccine).
Vaccines may be administered in Peru or abroad.

b. If the employee is over 40 years of age and is entitled to receive the third dose or ‘booster dose’ pursuant to the Ministry of Health’s rules, he/she should receive such booster to work in-person at the following places: shopping centres, shopping arcades, department stores, general stores, conglomerates, supply stores for basic necessities, markets, supermarkets, restaurants and the like, in internal areas, casinos, slot machines, cinemas, theaters, banks, financial entities, churches, temples, libraries, museums, cultural centres, art galleries, clubs, sports association venues, hairdressers, barbershops, spas, saunas, coliseums, gyms, notaries, professional associations, customer service offices, administrative procedure offices and document reception offices.

This requirement will apply to all personnel who work in establishments other than those mentioned above, but who must go through such venues in order to access their workplace, respectively.

In the event that an employee fails to comply with points a) or b) above, where applicable, his labour relationship will be suspended without pay (salary), until he produces evidence demonstrating he is in compliance with the vaccination requirements.
