Netherlands: The Bill “Admission for the Provision of Agency Workers” Adopted by Senate
Starting January 2027, employment agencies will be required to obtain official admission (permit). On January 1, 2028, companies using non-admitted agencies may face fines from the Dutch Labour Inspectorate.
On November 11, 2025, the bill Admission for the Provision of Agency Workers is adopted by the Senate.
This bill introduces an admission system for employment agencies and other companies that provide agency workers (lenders). The purpose of this system is to improve the position of agency workers, particularly labour migrants.
The core of this system is that lenders may only supply agency workers if they have been admitted. Likewise, companies that use agency workers may only do so through admitted employment agencies.
Requirements for employment agencies.
To be admitted under the new system, lenders must meet several requirements. These include:
- obtaining a Certificate of Good Conduct (VOG),
- transferring a security deposit of EUR 100,000,
- and demonstrating compliance with relevant legislation.
Sanctions for non-compliance
Both the non-admitted agencies and the companies that use agency workers from non-admitted agencies can be sanctioned for non-compliance with the new legislation by the labour inspectorate. These sanctions include:
- A formal warning
- a penalty to remedy the violation,
- an administrative fine of up to EUR 90,000 per violation,
- In the event of a repeat offense, the labour inspectorate may preventively shut down the company.
Timeline
- The law will take effect on January 1, 2027. Employment agencies that wish to continue supplying agency workers must register with the Dutch Authority for the Lending Market (NAU) before that date.
- On January 1, 2028, the Dutch Labour Inspectorate will begin enforcement.
