Poland: Suspension of the Labour Inspectorate Reform
On 6 January 2026, Prime Minister announced that work on the amendment to the Act on the National Labour Inspectorate would not be continued. The amendment was intended to allow labour inspectors to determine that the civil law relationship between the parties (contracts for specific work, contracts of mandate, B2B arrangements) constitutes an employment relationship.
The Prime Minister’s decision stems from concerns about excessive powers granted to officials, which could have a negative impact on businesses and jobs. At the same time, the Prime Minister has announced that he will seek the adoption of legislation implementing other solutions to protect workers against the abuse of flexible forms of employment. Therefore, the concept of an administrative decision as a remedy may return, although in a modified form.
