Brazil: Brazilian Federal Supreme Court Upholds the Equal Pay Law

On May 14, 2026, the Brazilian Federal Supreme Court (STF) unanimously upheld the constitutionality of the Equal Pay Law (Law No. 14,611/2023) in the context of ADC 92 and ADIs 7,612 and 7,631.

In its decision, the STF confirmed that the Equal Pay Law implements constitutional mandates aimed at combating gender discrimination and promoting pay equity. As a result, companies with 100 or more employees remain required to publish semi-annual salary transparency reports.

The central premise of the ruling was that, provided anonymization requirements are observed, the parameters established by the Law are consistent with the constitutional provisions ensuring the full pursuit of equal rights between men and women.

The STF’s decision also resolves the prior legal uncertainty surrounding the Equal Pay Law. Before this ruling, the enforcement of certain provisions had been partially suspended due to injunctions granted by lower courts.
