Poland: Act on Collective Labour Agreements

On 6 November 2025, the draft Act on Collective Labour Agreements and Collective Arrangements was submitted to the President for signature. Until now, this matter was regulated as part of the Labour Code, but it will be replaced by a separate act, although many existing provisions will be transposed into the new act.

Among the new provisions introduced by the act are:

  • Expansion of the range of matters that may be covered by a collective labour agreement.
  • Possibility of including in the agreement persons performing paid work other than employees (e.g., individuals working under a contract of mandate).
  • Creation of the National Register of Collective Labour Agreements (KEUZP) – a system in which collective labour agreements and their additional protocols, as well as collective arrangements and their additional protocols, will be mandatorily registered.
  • Although the Minister responsible for labour affairs will not verify the content of submissions to the KEUZP for legal compliance, an unregistered agreement will not be applicable. The provisions of an agreement will enter into force on the date specified therein, but not earlier than the date of proper registration.
  • Judicial review of the legal compliance of an agreement’s provisions will take place upon application by an authorised entity.
  • Possibility of involving a mediator in the negotiations for concluding a collective labour agreement.

 

The new regulations will enter into force 14 days after their publication in the Journal of Laws.
